General Terms and Conditions
This is a translation provided for your information. Only the German version is legally binding. Deutsch
01. The travel contract comes into effect upon written booking confirmation from ConcerTour. This is usually sent by post.
02. Changes to the programme and cast at musical events resulting from cancellations, illness or other impediments on the part of artists are expressly reserved and do not constitute grounds for cancellation (it is the customer's responsibility to obtain information about cast changes). Short-notice changes to the starting times of musical events are reserved. Please therefore check the actual start of your performance on site.
03. If an event is cancelled due to force majeure or bad weather, the customer will only be refunded the printed ticket value; no further claim exists.
04. Cancellation fees in the event of cancellation by the customer:
Up to the 90th day before departure 10% of the travel price, at least € 50.- per person
from the 89th to the 31st day before departure 30% of the travel price
from the 30th to the 15th day before departure 50% of the travel price
from the 14th to the 7th day before departure 70% of the travel price
from the 6th day before departure 90% of the travel price
The cost of the tickets is payable in addition to the flat-rate cancellation fees, unless the tickets can be exchanged or taken back by the organiser or sold elsewhere.
The cost of tickets is often many times higher than the printed value. The purchase of tickets for performances with a "star cast" requires substantial funding and is made at the beginning of the season. If an artist cancels their appearance at a later date, the cost of the tickets cannot be reduced.
ConcerTour may, upon providing proof, claim damages higher than the flat-rate cancellation costs; in particular for tickets that cannot be resold.
If a musical event is cancelled by the organiser, ConcerTour will charge a processing fee of € 90.- per person as compensation for expenses.
05. Upon conclusion of the contract, a deposit becomes due, which corresponds approximately to the value of the tickets.
The remaining balance is due 6 weeks before departure.
After full payment of the travel price, ConcerTour will send the travel documents up to 2 weeks before departure.
06. Insolvency insurance with R + V Versicherung in Wiesbaden, protecting customer funds, is included in all trips. Personal data and any data that may be necessary can be made available to R + V Versicherung.
07. If the trip is made more difficult, impaired or endangered by unforeseeable force majeure, both ConcerTour and the customer may terminate the travel contract. In the event of termination, ConcerTour may demand appropriate compensation for travel services already provided or for travel services still to be provided in order to conclude the trip.
08. The contractual liability of ConcerTour is limited to three times the travel price, insofar as the customer's damage is neither caused intentionally nor through gross negligence, or insofar as the damage is attributable to the fault of a service provider.
09. We recommend taking out travel cancellation insurance to cover the event of illness.
10. The traveller alone is responsible for complying with and checking the currently valid passport, visa and health regulations.
11. In accordance with § 36 VSBG, ConcerTour wishes to inform you that we do not participate in dispute resolution proceedings before a consumer arbitration board.
12. The place of jurisdiction for the contracting parties is Bad Sobernheim/Rhineland-Palatinate/Germany.
GENERAL TERMS AND CONDITIONS FOR TICKETS
01. The contract comes into effect upon written ticket confirmation from ConcerTour.
02. Tickets are excluded from exchange or return. If an event is cancelled by the organiser, only the officially printed ticket price on the ticket can be refunded. Any fees beyond this cannot be refunded. Likewise, postage and shipping costs cannot be refunded. Amounts in foreign currency are settled at the daily exchange rate.
03. At the customer's request, we can attempt to resell the tickets, possibly also below the printed value. If the resale is successful, the refund will be paid out to the customer without delay. If the resale is unsuccessful, the tickets will be sent to the customer by post.
04. Insofar as ConcerTour offers services in the area of leisure events, in particular tickets for events, this does not constitute a distance selling contract pursuant to § 312b BGB. This means that a two-week right of withdrawal and return is excluded. Every ticket order is therefore binding immediately after confirmation by ConcerTour and obliges the customer to pay for and accept the ordered tickets.
05. Ordered tickets are generally to be paid for immediately upon receipt of the invoice. In exceptional cases, we reserve the right to require payment in advance.
06. Changes to the programme and cast at musical events resulting from cancellations, illness or other impediments on the part of artists are expressly reserved and do not constitute grounds for cancellation.
07. If an event is cancelled due to force majeure or bad weather, the customer will only be refunded the printed ticket value; no further claim exists.
08. ConcerTour acts solely as an intermediary for the tickets.
09. Once the order has been received, tickets can no longer be cancelled.
10. The ticket prices include the brokerage fee as well as advance booking fees and/or third-party agency fees and procurement costs. This results in deviations from the printed ticket price. These deviations can be considerable, in particular for events in high demand and/or already sold out locally.
11. Upon receipt of the tickets, the shipment must be checked immediately for correctness, as later complaints cannot be recognised.
12. If ticket delivery is impossible due to circumstances for which ConcerTour is not responsible, we reserve the right of extraordinary cancellation. In this case, ConcerTour will refund all payments already received. The customer has no further claims.
13. The tickets remain the property of ConcerTour until payment has been made in full.
14. In accordance with § 36 VSBG, ConcerTour wishes to inform you that we do not participate in dispute resolution proceedings before a consumer arbitration board.
15. The place of jurisdiction for the contracting parties is Bad Sobernheim/Rhineland-Palatinate/Germany.
